Terms of Service

1. Acceptance of terms

By creating an account or using Donna ("the Service"), operated by Magic Labs ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Donna is an AI-powered personal assistant that connects to your Google Workspace (Gmail, Calendar, Drive), Notion, and WhatsApp to help you manage tasks, draft emails, schedule meetings, and retrieve information through natural language. The Service is provided "as is" and is subject to change without notice.

3. Eligibility

You must be at least 13 years old to use Donna. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Your account

You sign in using your Google account. You are responsible for all activity that occurs under your account. You agree to:

  • Keep your Google account credentials secure
  • Notify us immediately of any unauthorised access
  • Not share your account with others
  • Provide accurate profile information

5. Acceptable use

You agree not to use Donna to:

  • Violate any applicable law or regulation
  • Send spam, phishing emails, or other unsolicited messages
  • Harass, threaten, or harm any person
  • Attempt to reverse-engineer, scrape, or exploit the Service
  • Circumvent rate limits, billing, or security controls
  • Access other users' data or accounts
  • Generate or distribute illegal, harmful, or deceptive content

We reserve the right to suspend or terminate accounts that violate these rules without notice.

6. Third-party integrations

When you connect a third-party service (Google, Notion, WhatsApp), you authorise Donna to access and act on that service on your behalf, within the permissions you grant during the OAuth flow. You remain responsible for your use of those third-party services and for complying with their respective terms of service. We are not responsible for the availability or actions of third-party services.

7. Subscription and billing

Donna offers a free trial period followed by paid subscription plans. By subscribing:

  • You authorise us to charge your payment method on a recurring basis
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis — contact us within 7 days of a charge
  • We reserve the right to change pricing with 30 days' notice

Payments are processed by Dodo Payments. We do not store your card details.

8. Intellectual property

Donna and all associated software, designs, and trademarks are owned by Magic Labs. You retain ownership of your data and content. You grant us a limited licence to process your data solely to deliver the Service. We do not claim ownership over emails, documents, or other content you access through integrations.

9. AI limitations

Donna uses large language models to generate responses. AI responses may be inaccurate, incomplete, or outdated. You should not rely solely on Donna for legal, medical, financial, or other professional advice. Always verify important information independently before acting on it.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

You may delete your account at any time from Settings. We may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
